Bottlecaps

This subject, i know has been around the forums a few times but i just want to make sure about it.
I have recently purchased The factory e30 bottlecaps with the intention of simply bolting them straight on. Of course this didnt happen, the edge hits the steering control ball joint. I have measured how much more clearance i would need and it needs at the very least 5mm extra. First question.
Is there a problem buying those slip on wheels spacers on ebay for like $30 aus?
Will this make the wheel rub on the arches or do unnecessary tyre wear?
Now im not certain about this but, are they by any chance illegal?

that will work but your gonna suffer everytime you want to put your front wheels on.
